The VCAT Guardianship Tribunal Second Ambush of
Lynette Croll
The Ambush No 2 involved Lynette going to a geriatrician of the Daughter's choosing who was to be prejudiced by the Daughter's representations and would thus find Lynette was incompetent. The order that did this. The original order received in the mail did not state this. I remember Robert Scott saying at the Tribunal Hearing that Lynette was to go to a geriatrician of her daughter's choosing.
This order clearly does not seek the truth but seeks the outcome desired by Lynette's daughters. This is a lie - "The proposed represented person, agreed to undergo an assessment by a geriatrician or neuropsychologist, nominated by the applicants." - Lynette agreed to another assessment by a geriatrician or neuropsychologist but not to one nominated by the applicants. At this hearing the application should have been dismissed which Lynette had asked for and was ignored on.
Lynette, had not to this date been given a fair hearing by the Tribunal so smelt a rat. Lynette went to a geriatrician at the Warragul Hospital who found that she was competent. The report of Dr Craig Clarke. Dr Craig Clarke's report was ignored.
The Registrar of the Tribunal phoned Lynette and tried to tell her that the order was incorrect and that she had to go to a geriatrician of the applicants choosing. This is the letter in reply. Lynette had every right to accept the written order as the order.
Lynette prepared another Statutory Declaration for the Tribunal which was ignored.
Lynette Faye Johnson's solicitors, Kratz Silverman - JAKE Jawecki, also wrote to Lynette with an appointment. When they were told Lynette had her own geriatrician they wrote with an application to the Tribunal for an order that Lynette see a geriatrician or neuropsychologist of the Applicant's choosing. Their application was taken notice of and a hearing scheduled. Lynette had sought that there be a hearing and the application be dismissed and this was not entertained.
At the hearing Lynette Croll refused to see a geriatrician or
neuropsychologist of the applicants choosing.
Robert Scott should have considered Lynette's application
that the application to the Guardianship List be dismissed, he instead made an order that the Public Advocate
Investigate.
Lynette and Trevor went to Queensland to escape the harassment, the Tribunal, the threats and death threats, the ill health of Victoria and it all.
